ECAR Fact Sheet for Virginia
Hazardous Wastes

Wastes are classified as "hazardous" if they have certain dangerous properties (for instance, if they are flammable, corrosive, or toxic).  Wastes can also be automatically classified as hazardous if they are produced in certain manufacturing processes.

Hazardous waste generated by auto recycling/salvage yards may include (but are not limited to):

  • Spent solvents
  • Solvent contaminated wipers/shop towels
  • Waste paints
  • Used antifreeze contaminated with metals, solvents or fuels
  • Used oil contaminated with metals, solvent or fuels
  • Contaminated gasoline
  • Lead-acid batteries.

If you manage hazardous waste, you must determine your generator status. Most automotive recycling facilities will fall under one of these two classifications.

  1. The "Small Quantity Generator" (SQG) is described as those generators who generate more than 100 kg but less than 1000 kg of hazardous waste during a calendar month, or generate less than 1 kg of acute ("P-list") hazardous waste in a month, and who never accumulate more than 6000 kg of hazardous waste at any time. Management of SQG waste is regulated under the general requirements of 40 CFR Part 262, as adopted by reference into the Virginia Hazardous Waste Management Regulations (VHWMR).
Additional guidance from the Virginia Department of Environmental Quality applicable to SQGs.

  2. Conditionally Exempt Small Quantity Generators (CESQGs) are defined as those generators who generate less than 100 kg/month of all hazardous wastes, or less than 1 kg/month of acutely hazardous waste (or less than 100 kg of spill residue from an acutely hazardous waste), and who never accumulates more than 1000 kg of hazardous waste at any time. Management of CESQG waste is regulated under 40 CFR Part 261.5, as adopted by reference into the Virginia Hazardous Waste Management Regulations (VHWMR). The Virginia regulations also include additional requirements beyond federal requirements related to CESQGs waste disposal.
Additional guidance from the DEQ regarding CESQGs

  3. The third generator status is the "Large Quantity Generator" (LQG) and is described as those generators who generate more than 1000 kg of hazardous waste during a calendar month, or generate more than 1 kg of acute ("P-list") hazardous waste in a month.
